This English version is provided for information only. The binding text is the Spanish one, and these Terms are governed by Colombian law. In the event of any discrepancy between the two versions, the Spanish version prevails.
1. Purpose and scope
These Terms and Conditions of Use (the "Terms") govern access to, browsing of and use of the website www.housinn.co (the "Portal"), operated by HOUSINN.CO S.A.S., NIT 901.937.358-1, with registered office in Medellín, Antioquia, Colombia.
Use of the Portal implies express, full and irrevocable acceptance of these Terms. Users who do not agree with any of the conditions set out here must refrain from using the Portal.
These Terms are governed by Colombian law, including Law 527 of 1999 (Electronic Commerce), Law 1480 of 2011 (Consumer Statute), Law 1581 of 2012 (Data Protection) and related regulations.
The booking conditions themselves — price, payment, cancellation, withdrawal and obligations during the stay — are not governed here but in the Booking Terms and Conditions, a separate document published on this same Portal.
2. Using the Portal without registration
The Portal offers no user registration and no personal accounts. There is no need to create an account, choose a password or sign in to browse the apartments, check availability, get a price or start a booking. Accordingly, users take on no obligation to safeguard credentials towards the Portal.
The list of saved apartments and the selected currency are stored only in the user’s own browser. They are not sent to the Portal, are not linked to any person, and disappear when browser data is cleared or another device is used.
The booking process continues and is completed on our property management system’s platform, where the user provides their details and makes payment. What happens there is governed by the Booking Terms and Conditions and by that platform’s own terms.
Users warrant that all information they provide through the Portal, including the contact form, is truthful and does not belong to third parties without their authorisation.
3. Intellectual property
3.1 Ownership of content
All content published on the Portal — including, without limitation, texts, designs, logos, trade marks, photographs, images, videos, illustrations, software, source code, databases and any other material — is the exclusive property of HOUSINN.CO S.A.S. or its licensors, and is protected by Law 23 of 1982 (Copyright), Andean Decision 351 of 1993 and other intellectual property rules applicable in Colombia.
Third-party trade marks and logos shown on the Portal — in particular those of the booking platforms where HOUSINN.CO S.A.S. lists its properties — belong to their respective owners and are displayed solely to identify those channels.
3.2 Permitted use
Access to the Portal grants users no intellectual property rights over its content. Users may only view and download content for personal, non-commercial use, keeping all copyright and ownership notices intact.
3.3 Prohibited uses of the content
Without prior written authorisation from HOUSINN.CO S.A.S., it is expressly prohibited to:
- Reproduce, copy, distribute, publicly communicate, transform or modify the Portal’s content.
- Use the property photographs, logos or trade marks of the Portal for commercial, advertising or any other purposes.
- Reverse engineer, decompile or disassemble any software component of the Portal.
- Extract, reuse or reproduce the Portal’s content to create competing databases, applications or services.
PARAGRAPH: Breach of these prohibitions will give rise to the civil and criminal actions provided for in Colombian intellectual property and copyright law.
3.4 Property photographs and images
The property photographs published on the Portal are owned by HOUSINN.CO S.A.S. or have been expressly authorised by the owners or managers of those properties. Their use without written authorisation is strictly prohibited for: commercial social media posts, media outlets, third-party advertising materials, competitor portals or any other non-personal use.
4. Prohibited uses of the Portal
Users undertake to use the Portal in accordance with the law, these Terms and generally accepted standards of conduct. In particular, it is strictly prohibited to:
- Use the Portal for unlawful or fraudulent purposes or purposes contrary to public order.
- Transmit, introduce or spread computer viruses, malware, ransomware or any malicious code.
- Attempt to gain unauthorised access to computer systems, servers or networks of HOUSINN.CO S.A.S. or third parties.
- Carry out activities that overload, damage or impair the Portal (denial-of-service attacks, mass automated extraction, etc.).
- Publish, transmit or distribute obscene, defamatory, discriminatory or threatening content, or content infringing third-party rights, including through the contact form.
- Impersonate HOUSINN.CO S.A.S., its staff or other users.
- Use the Portal for activities linked to money laundering, terrorist financing, drug trafficking or any other offence under Colombian law.
- Use the Portal to promote or facilitate the commercial sexual exploitation of children and adolescents (ESCNNA), in compliance with Law 679 of 2001.
- Make fictitious or fraudulent bookings, or bookings using third-party information without consent.
5. Access restriction for abusive use
As there are no user accounts, there is no registration to suspend or cancel. However, HOUSINN.CO S.A.S. may apply technical measures to restrict or block access to the Portal, immediately and without prior notice, where it detects:
- Breach of the prohibitions in section 4.
- Mass automated extraction of content, or requests that degrade the service.
- Booking attempts using false details, third-party details without authorisation, or unauthorised payment methods.
- A request or order from a competent judicial or administrative authority.
Restricting access does not release the user from outstanding financial obligations to HOUSINN.CO S.A.S. arising from confirmed bookings, nor does it affect the rights granted to them by the Booking Terms and Conditions.
6. Portal availability and limitation of liability
HOUSINN.CO S.A.S. will use its best efforts to keep the Portal continuously available; however, it does not guarantee that access will be uninterrupted, error-free or completely secure. The Portal may be temporarily suspended for maintenance, technical updates, force majeure or causes beyond the operator’s control.
The availability, photographs, amenities and prices shown on the Portal come in real time from the property management system. They may change between the time of enquiry and booking confirmation, and prices shown as approximate on other platforms are estimates, not offers.
HOUSINN.CO S.A.S. will not be liable for: (i) damage arising from Portal interruptions; (ii) typographical errors or inaccuracies in published information; (iii) the content of third-party websites linked from the Portal; (iv) damage caused by viruses or other harmful technological elements that users may download from the Portal.
7. Third-party links
The Portal contains links to third-party services, in particular:
- The booking and payment platform of our property management system, where the contract is completed.
- The online travel agencies (OTAs) where HOUSINN.CO S.A.S. also lists its properties.
- WhatsApp, when the user chooses that channel to get in touch.
- Social networks and map services.
HOUSINN.CO S.A.S. neither controls nor is responsible for the content, privacy policies or practices of those sites. Access to them is the user’s sole responsibility and is governed by each provider’s own terms.
8. Changes to these Terms
HOUSINN.CO S.A.S. reserves the right to amend these Terms at any time. Amendments take effect from the moment they are published on the Portal. Continued use of the Portal after changes are published implies acceptance of the amended Terms.
9. Applicable law and jurisdiction
These Terms are governed by the laws of the Republic of Colombia. For any dispute arising from their interpretation or performance, the parties submit to the jurisdiction of the courts of Medellín, waiving any other forum that might apply.
